Germany: Algeria, Morocco and Tunisia remain "unsafe" countries of origin – votes Bundesrat

The German Federal Council (Bundesrat) in Berlin voted against a bill passed by the Bundestag reclassifying Algeria, Morocco and Tunisia as safe countries of origin, Friday.

Thuringian Minister for Migration, Justice and Consumer Protection from the Green Party Dieter Lauinger maintained there was "still uncertainty on the legal situation of gays in these countries, which was reported on again and again by human rights organisations. Also, there are reports that political activists and dissidents are exposed to repression from the government."

Minister of the Interior of the state of Bavaria Joachim Hermann, from the Christian Social Union (CSU), who supported the bill countered that "Most of the cases with refugees coming from Algeria, Morocco and Tunisia are flagrant abuse of asylum policy."

The three North African countries were classed "safe" countries of origin by the German Bundestag in May subject to the vote in the Bundesrat. However, the bill did not get the necessary 35 out of 69 in order to pass.

The safe status introduces a legal presumption that applications for asylum lodged by citizens of the named countries are unfounded. Applications would be rejected unless the asylum seeker could prove genuine grounds for being granted.
