Netherlands: Russia defends against Ukrainian accusations at The Hague

Russia gave its final statement in the round up of oral observations of the International Court of Justice (ICJ) case between Ukraine and Russia at the Peace Palace in The Hague on Thursday.

Russia told the court they reject the request for an indication of provisional measures submitted by Ukraine. The Russian defence also stated that Ukraine has failed to demonstrate either "risk of irreparable prejudice" or "urgency."

Speaking on behalf of Ukraine, UK Attorney Sam Wordsworth, stated that there is no evidentiary basis "whatsoever" for the allegation that Russia supplied the alleged weapon that shot down the MH17 with a "requisite knowledge or intent."

He also stated that there was no response to the fact that Ukraine is as engaged in acts of indiscriminate shelling that caused multiple civilian deaths and injuries. He said that indiscriminate shelling is in fact higher on the DPR/LPR controlled side of the contact line.

Russian representative, Roman Kolodkin, asked the ICJ to "look a little deeper into the facts." He stated that Ukraine has discriminated against Crimean Tartars for years and continues to the present day. He then outlined how Ukraine also supports a blockade, which has a "high toll" on the residents of Crimea, whom Ukraine "pretends to protect."

Kolodkin said that Ukraine repeatedly claimed their request was on behalf of the "vulnerable population" of Ukraine. However, the office of the High Commission of Human Rights report submitted by Ukraine, records that Ukraine's armed forces have engaged in indiscriminate shelling that has led to numerous civilian casualties in the east of Ukraine.

Ukraine is asking the court to rule that Russia must cease financing separatist groups in eastern Ukraine and stop discriminating against Tartars and Ukrainians in Crimea. Kiev will also demand Russia pay compensation for Malaysia Airlines Flight MH17, which was shot down in 2014.
